Terms of service
1. Agreement
By accessing this site or engaging services (including via WhatsApp, email, or signed proposal), you agree to these terms. If you disagree, do not use the site or services. Specific projects may be governed by a separate statement of work (SOW); where there is a conflict, the SOW prevails for that project.
2. Services
Services may include web development, design, rescue work, consulting, and related deliverables as described in your quote or SOW. Deliverables outside the agreed scope may require a change order and additional fees.
3. Fees & payment
Fees are quoted in EUR (€) by default. Other currencies (for example USD) only when explicitly agreed in your quote. Deposits or milestone payments may be required before work begins or continues. Late payments may pause work and incur statutory interest where permitted by law.
4. Intellectual property
Upon full payment for custom work, client receives rights as defined in the SOW (typically a licence to use the delivered site or assets). Third-party components (fonts, libraries, stock assets) remain subject to their licences. Joshua Momo may showcase non-confidential work in a portfolio unless a written confidentiality agreement states otherwise.
5. Client responsibilities
You agree to provide timely content, access (hosting, DNS, accounts), feedback within agreed windows, and accurate information. Delays on your side may shift timelines without liability for missed dates.
6. Warranties & liability
Services are provided with professional skill and care. To the maximum extent permitted by law, liability is limited to fees paid for the specific engagement giving rise to the claim. No guarantee of specific business results (revenue, rankings) is offered; outcomes depend on many external factors.
7. Termination
Either party may terminate for material breach if uncured within a reasonable notice period. Fees for work completed and non-refundable deposits remain due as per the SOW.
8. Governing law
These terms are governed by the laws of South Africa, without regard to conflict-of-law rules. Courts of South Africa have jurisdiction where applicable, subject to mandatory consumer protections in your country of residence where those laws cannot be contracted away.
9. Changes
These terms may be updated; continued use of the site after changes constitutes acceptance where legally permissible.
